10/30/2003 Eighth Circuit Stays Beef Program Ruling - 10/30 Feedstuffs
The stay allows the National Beef Promotion & Research Board to continue assessing beef cattle producers the beef checkoff, which is allocated for funding beef advertising and promotion, consumer information, industry research and producer education. The stay will be in place until the district court's ruling is appealed to the U.S. Supreme Court and the high court grants certiorari to hear the appeal.
A circuit panel, in considering an appeal of the district court's ruling to the circuit, upheld the ruling earlier this year, and the full circuit refused earlier this month to rehear the appeal. Attorneys representing the beef program then asked for the stay while appealing to the high court.
The beef checkoff collects $1 per head of cattle in all cattle selling transactions.
